Re: Revision of labour-management agreement based on the provision of Article 30-4(1) of the Worker Dispatch Law


This notice is hereby given that the “labour-management agreement based on the provision of Article 30-4(1) of the Worker Dispatch Law” (the “LMA”) was amended in accordance with the corrective instruction, which had been issued by the Director-General of the Tokyo Labour Bureau on July 20, 2021. For the avoidance of doubt, these amendments will not involve any amendments to the treatments of dispatched workers.


Notes


Amendment 1

The following sentence was added to the end of 3.1.1 of the LMA: “Provided, however that, when determining the type of work of a Subject Employee and the same type of work thereof for the purpose of setting forth the Standard Number in an Individual Dispatch Agreement, the sub-category of Appendix 1 shall be used by deeming that the types of work therein most appropriately reflect types of work of the said Subject Employees.”


Amendment 2

The following sentence was added to the end of 3.1.3 of the LMA: “Provided, however, that, when determining the location of dispatched workplace of a Subject Employee for the purpose of setting forth the Regional Index in an Individual Dispatch Agreement, the Regional Index by Hello Work specified in Appendix 3 shall be used by deeming that the indices therein more precisely reflect regional characteristics of the said locations of dispatched workplaces.”

The table in Appendix 5 of the LMA was amended as below (as shown in bold):

Applicable for:
Dispatch Workers who are expected to have employment for 1 year or more.

Method:
1.Taking e-Learning courses by PC/mobile
2.Free of charge

Payment:
Once you complete e-Learning courses, such hours shall be deemed to be your work hours and you shall be paid by your hourly wage up to 8 hours per year.
*Because e-Learning is unsupervised, if you did not complete the courses, then you shall not be paid for the hours.

Rules:
Please take the courses outside of your work hours.
Please do not take the courses when you are taking paid leaves because you are not supposed to be working on such days.
